Guide to Divorce

Your divorce requires careful preparation and the guidance of a divorce attorney well versed in Oklahoma divorce laws. Even the simplest uncontested divorce will require a court filing, a division of assets and debts and a detailed documenting of all child custody and child support arrangements.


Custody & Visitation

The most important thing when it comes to children is a close and nurturing relationship. At the end of any custody or divorce case involving children, the Oklahoma court makes a ruling as to which parent will have legal custody of the children and how much parenting time a child spends with each parent.


Child Support

Regardless of which party is awarded custody of the children, child support will be an issue in the case. Unless the parents otherwise agree, the obligation to pay child support generally ends when a child turns 18 years of age (up to 20 years of age if the child is still enrolled in high school).


Property Division

In Oklahoma, “marital property” is divided equitably. “Marital property” is property which was acquired by either spouse after the marriage with marital labor or funds earned during the marriage. It does not matter who holds title to the property, or who provides the funds for the property.



Oklahoma courts can provide for spousal support (alimony) following a divorce. The criteria considered in an award of spousal support include: need of the recipient and the ability to pay of the payor. Spousal support is usually considered “rehabilitative” to help the recipient make the transition to entering the workforce and setting up an independent household.



Retirement funds and other property acquired prior to marriage is the separate property of the party who holds title to that property. Assets purchased with separate property can, in some cases, still be considered separate property, even if the purchase was after the marriage.
